适用范围

美国《合众国法典》第18编第2257条和第2257A条对部分露骨或模拟性行为影像的制作者提出身份核验、年龄记录和记录保管要求。具体内容是否适用，以及网站、上传者或原始制作方是否属于法律所规定的“制作者”，应当根据内容来源、制作过程和实际参与方式判断。

黄瓜网不会仅凭内容标签、栏目名称或本页面的声明，认定某项内容当然适用或不适用相关法律。

内容来源与记录责任

黄瓜网部分内容由站内作者整理，部分来自用户投稿、第三方创作者或公开网络资料。

对于依法由第三方制作并提供的内容，与表演者身份、出生日期、曾用名及制作过程有关的记录，应由法律规定的原始制作方或记录保管人建立并保存。相关记录信息应以具体内容页面、原始作品或制作方公布的2257声明为准。

如果某项内容依法要求黄瓜网承担记录保存责任，黄瓜网将按照适用规定保存相应资料，并在法律要求的范围内配合有权机关进行查验。

第三方提供内容时，不得使用虚假身份、伪造年龄证明，或隐瞒内容涉及未成年人、胁迫、偷拍及未经同意传播等情况。

成年内容限制

黄瓜网仅面向年满18周岁，并且达到所在地法定成年年龄的用户。未满足上述条件的用户不得访问站内成人栏目。

站内不允许发布、上传或传播以下内容：

• 涉及未成年人或疑似未成年人的色情内容；
• 无法确认参与者已达到法定年龄的露骨影像；
• 偷拍、胁迫、人口贩运或未经本人同意制作的内容；
• 未经同意公开或传播的私密影像；
• 通过伪造身份、年龄资料或授权文件提交的内容；
• 其他违反适用法律或网站规则的内容。

内容中的人物外貌、角色设定或标题描述不得用于规避年龄要求。只要存在合理的年龄疑问，相关内容都可能被限制访问或移除。

用户投稿要求

向黄瓜网投稿成人内容，投稿人应当确认：

1. 内容中的所有参与者在拍摄时均已达到法定成年年龄；
2. 所有参与者均在知情、自愿的情况下参与拍摄；
3. 内容的制作、持有和传播已经取得必要授权；
4. 投稿人有权向黄瓜网提交并允许网站展示相关内容；
5. 依法需要保存的身份和年龄记录真实、完整且可供核查。

黄瓜网可以要求投稿人补充内容来源、授权情况或记录保管信息。无法说明来源、存在年龄疑问或被合理怀疑违反上述要求的内容，可能不会发布。

This statement explains Huanggua’s policies concerning content that may be subject to the record-keeping and labeling requirements of 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75.

This page is provided for general compliance information. It is not legal advice and does not replace any identity, age-verification or record-keeping documentation required by applicable law.

Scope of the Law

Sections 2257 and 2257A establish identity, age-verification, record-keeping and disclosure requirements for certain visual depictions of actual or simulated sexually explicit conduct.

Whether a particular item is subject to these requirements, and whether a website, uploader, creator or other party qualifies as a “producer,” depends on the origin of the content, the production process and the party’s actual involvement.

Huanggua does not assume that content is automatically covered by or exempt from these requirements based solely on its title, category, format or source.

Content Sources and Record Responsibility

Material appearing on Huanggua may be organized by site authors or supplied through user submissions, third-party creators, external platforms and publicly accessible online sources.

For content legally produced and supplied by an independent third party, records concerning performer identity, date of birth, aliases and production details remain the responsibility of the producer or records custodian identified under applicable law.

Users should refer to the disclosure attached to the original work, the relevant content page or the original producer’s published records statement for information concerning the location and custodian of those records.

If Huanggua is legally required to maintain records for particular content, the required documentation will be maintained and made available to authorized authorities as required by applicable law.

Third-party suppliers must not provide false identity information, falsified age records or misleading authorization documents. They must not conceal facts suggesting that content involves a minor, coercion, exploitation, unlawful recording or non-consensual distribution.

Adults-Only Access

Huanggua is intended only for users who are at least 18 years old and have reached the legal age required to access adult content in their location.

Users who do not meet both requirements must not access adult sections of the website.

A person’s appearance, role, costume, description or fictional character setting does not override applicable age requirements.

Prohibited Content

Huanggua does not permit users or contributors to submit or distribute:

• sexually explicit material involving a minor or a person reasonably suspected of being a minor;
• material for which the depicted participant’s legal age cannot be reasonably established;
• hidden-camera recordings or material created through force, coercion, exploitation or trafficking;
• intimate images created or distributed without the depicted person’s consent;
• content submitted with false identity, age or authorization documents; or
• other material prohibited by applicable law or the website’s rules.

Content may be restricted or removed when a reasonable question exists concerning age, consent, origin or legal authorization.

Submission Requirements

A person submitting adult material to Huanggua must confirm that:

1. every depicted participant was of legal age when the material was created;
2. every participant knowingly and voluntarily agreed to participate;
3. the material was created, possessed and distributed with the necessary authorization;
4. the submitter has the right to provide the material for review and publication; and
5. any identity and age records required by applicable law are accurate, complete and available to the responsible records custodian.

Huanggua may request source information, authorization details or records-custodian information before publishing submitted material.

Material may be rejected, restricted or removed if its source cannot be explained, a participant’s age is uncertain, consent is disputed or the available information indicates that publication may violate applicable law or website policy.

Reporting Suspected Violations

If you believe that content on Huanggua may involve a minor, non-consensual activity, hidden-camera recording, coercion, trafficking, identity falsification, unlawful distribution or another serious violation, contact:

Please place “2257 Compliance Report” in the email subject line and include:

• the complete URL of the relevant page;
• the article title or another description that identifies the content;
• a clear explanation of the suspected issue; and
• any publicly available information that may assist the review.

Do not download, save, screenshot, attach or redistribute material suspected of depicting the sexual exploitation of a minor. A page URL and written description are sufficient for reporting purposes.

If a person appears to be in immediate danger, or the report concerns suspected child sexual exploitation, trafficking or another serious crime, contact the appropriate law-enforcement or reporting authority in your jurisdiction. Huanggua’s internal review process is not a substitute for an official investigation.

Review and Action

After receiving a sufficiently detailed report, Huanggua may locate and review the identified content and the information available concerning its source.

Depending on the circumstances, Huanggua may:

• restrict or disable access to the content;
• remove the relevant material or page;
• request additional information from the source or submitter;
• preserve information reasonably necessary to document the report;
• prevent repeated submissions from the same source; or
• cooperate with competent authorities when legally required.

Removal, restriction or continued review does not by itself constitute a final legal determination concerning the content or any person involved.

No Legal Advice

This statement is intended to describe the website’s content standards and reporting process. It does not determine whether a particular party qualifies as a producer, whether a particular depiction is subject to §§ 2257 or 2257A, or whether any person has fully complied with applicable law.
